SUBJECT:Policy on the Distribution of Supplemental Dislocated Worker Funds for Local Workforce Investment Areas (LWIAs)
PURPOSE:To establish the State’s Program Year (PY) 2006 policy on the distribution of State Level Rapid Response Funds to Local Workforce Investment Areas
BACKGROUND:In consultation with the Governor and State Workforce Investment Board, the New York State Department of Labor (NYSDOL) established the state policy for the distribution of supplemental State Level Rapid Response funds for PY 2006, to enable Local Workforce Investment Areas to serve new participants and existing participants with new services for PY 2006.
GUIDELINES:NYSDOL will make available supplemental Dislocated Worker allocations in PY 2006 to all eligible LWIAs based on the following monthly fiscal and related participant data:

Please Note: The calculation will be based on the LWIA’s original PY 2006 Dislocated Worker formula allocation from the NYSDOL, prior to any transfers to and/or from the WIA Adult funding stream. For example, if a LWIA’s original PY 2006 Dislocated Worker allocation is $100,000 and they transfer 30% or $30,000, to the Adult program, then the base for purposes of calculating whether they are eligible for a supplemental distribution is $100,000.

During the first quarter of PY 2006 (7/1/06 – 9/30/06), a LWIA must report accrued expenditures of at least 70% of the portion of their total PY 2006 Dislocated Worker funds made available to them on the July, 2006 Notice of Obligational Authority (NOA) and have fully expended their prior year’s Dislocated Worker allocations. The LWIA will then be eligible for a first supplemental distribution of funds equal to 15% of their total PY 2006 Dislocated Worker allocation, subject to NYSDOL review and approval, including but not limited to accuracy and appropriateness of local financial reports and services levels. As part of the review, NYSDOL will be examining the local area’s current PY 2006 Dislocated Worker participant services levels to ensure that these formula funds are being expended in an appropriate manner.

During the second quarter of PY 2006 (10/1/06 – 12/31/06), a LWIA must report accrued expenditures of at least 40% of their total PY 2006 Dislocated Worker formula allocation, have fully expended their prior year’s Dislocated Worker allocations and have received a first period supplemental Dislocated Worker distribution. The LWIA will then be considered for a second supplemental distribution of funds equal to 10% of their total PY 2006 Dislocated Worker formula allocation, subject to NYSDOL review and approval. Note: The first and second quarter expenditure level requirements will exclude any Dislocated Worker supplemental funds received during PY 2006 and the PY 2005 TAA staff-related services and training-related services funds that were allocated in March 2006.

ACTION:To ensure timely review and approval of supplemental fund distribution, LWIAs must submit their monthly financial reports on a timely basis and assure the participant data, in their respective management information/case management system, are current at all times, since those are the basis for NYSDOL review and approval.

Upon notification by NYSDOL that the LWIA is eligible to receive a PY 2006 Dislocated Worker supplemental fund distribution, the LWIA will be required to submit the attached “Proposed Participant Plan for Supplemental Dislocated Worker Funds” along with a narrative describing what types of services (core, intensive and training) will be provided to the new and/or existing participants for each distribution of supplemental Dislocated Worker funds immediately for NYSDOL consideration.

This proposed plan submitted for use of the supplemental funds must be consistent with the State’s objective for increased participant service levels and increased training services to dislocated workers.

Workforce Development and Training Division (WDTD) Field staff will review the LWIA’s actual reported expenditures, participant levels, and service levels including any prior year’s supplemental Dislocated funds they have received. If the local area is approved for a supplemental Dislocated Worker funds distribution, a NOA will be issued.

Supplemental Dislocated Worker allocations distributed during PY 2006 must be fully expended by June 30, 2007. The WDTD Field staff will monitor against the actual participant levels to ensure that it is consistent with the approved supplemental plan submitted by the LWIA.

Note: This policy will be amended on an as needed basis to reflect the accrued expenditure patterns of the local areas and the amount of State Level Rapid Response funding availability.
